Texas does not allow for the use of medical marijuana, something that is very common in most other states. Additionally, a number of states have legalized recreational marijuana – from California to Colorado to Michigan to Maine. Texas has not yet followed suit, although more and more states are passing recreational marijuana laws every few years.
In any case, Texas residents know that they can’t legally buy products in the state where they live. They also know that they can make legal purchases in other states, at least if they are over 21 years old. So does this mean that they could drive to another state, make this purchase legally, and then just bring the products back to Texas? Would that be a way to get around Texas’s older and stricter marijuana laws?
A violation of state law
The short answer is no, and a big part of the reason is that this would still violate the laws in Texas. If the police pull someone over and find marijuana products in their car, for instance, they are not going to care if they legally bought those products in Colorado. They’re still illegal in Texas and the driver could be arrested.
A violation of federal law
Moreover, marijuana is still illegal under federal law. As with other types of crime, when an activity crosses state lines, it enters federal jurisdiction. Bringing marijuana products into Texas from any other state, even if they were legal there, breaks these federal restrictions.
